In terms of AI-assisted trial to the substantive justice, AI-assisted trial can promote the legal certainty in formal justice and the past-oriented expediency of the law, but there are obstacles to the value judgment of essential justice in the law and the future-oriented expediency of the law. At present, the human-AI collaboration path is used to construct the human-AI relationship in trial, and the AI judge can be considered in the future.
