For the audience to walk away with: 1) an understanding of the types of violations that occur online by state and non-state actors; 2) understanding prospects for digital rights litigation in MENA (domestically and internationally); 3) an exchange on how non-MENA digital rights litigation can contribute to the accountability culture for digital rights violations in MENA.
This session will bring lawyers and civil society advocates together to discuss litigating digital rights across MENA before national and international mechanisms.
The conversation will focus on how MENA governments weaponize online platforms to restrict fundamental rights and liberties through the practice of internet shutdowns, targeting of expression online, and content and media censorship. The panelists will discuss opportunities and challenges advocates face when litigating digital rights domestically and any alternative tools available to them to hold the government and tech companies accountable for digital rights violations.
They would also reflect on current efforts from the region to hold governments accountable for digital rights violations, notably the litigation led by civil society challenging internet shutdowns in Sudan, and further explore why digital rights litigation is underutilized across MENA countries.
ستجمع الجلسة محامين وناشطين من المجتمع المدني لمناقشة التقاضي بشأن الحقوق الرقمية في منطقة الشرق الأوسط وشمال أفريقيا أمام الآليات الوطنية والدولية. ستركّز المحادثة على كيفية استخدام حكومات منطقة الشرق الأوسط وشمال أفريقيا للمنصات الإلكترونية كسلاح لتقييد الحقوق والحريات الأساسية من خلال ممارسة قطع الإنترنت واستهداف حرية التعبير عبر الإنترنت والرقابة على المحتوى والإعلام. سيناقش المتحدّثون الفرص والتحديات التي يواجهها الناشطون عند التقاضي بشأن الحقوق الرقمية محليًا وأي أدوات بديلة متاحة لهم لمساءلة الحكومة وشركات التكنولوجيا عن انتهاكات الحقوق الرقمية. كما أنّهم سيبحثون في المساعي الحالية التي تبذلها المنطقة لمساءلة الحكومات عن انتهاكات الحقوق الرقمية، ولا سيما الدعوى التي يقودها المجتمع المدني لمواجهة عملية قطع الإنترنت في السودان، واستكشاف سبب عدم استخدام التقاضي بشأن الحقوق الرقمية بشكل كافٍ في دول الشرق الأوسط وشمال أفريقيا.
Meroua Zouai is the Legal Associate at the Tahrir Institute for Middle East Policy (TIMEP). As a US-trained human rights lawyer, she has dedicated her career to pursuing accountability for human rights violations and increasing access to justice across MENA and West Africa by working with local and international NGOs. She received her J.D. and M.A. in International Studies from the University of Pennsylvania with a Global Human Rights Certificate.
